1. Acceptance of Terms

By downloading, installing, or using the ResoPod application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Zhewei Liang ("Developer," "we," "us," or "our").

2. Description of Service

ResoPod is an AI-powered assistant application that uses Google Gemini technology to provide conversational support and information. The App is designed to be a general-purpose AI assistant and is not intended to provide medical, legal, financial, psychological, or any other form of professional advice. The information and responses generated by the App should not be treated as a substitute for professional consultation.

3. User Accounts and Responsibilities

When you create an account with ResoPod, you agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized use of your account
  • Not use the App for any unlawful, harmful, or abusive purpose
  • Not attempt to reverse-engineer, decompile, or otherwise extract the source code of the App

You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Subscriptions and Payments

ResoPod offers subscription plans that provide access to premium features. By subscribing, you agree to the following:

  • Billing: Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan you choose). Payment is charged to your Apple ID account at confirmation of purchase.
  • Auto-Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Managing Subscriptions: You can manage or cancel your subscription at any time through your Apple ID account settings or the App Store.
  • Free Trials: If a free trial is offered, any unused portion of the trial period will be forfeited when you purchase a subscription. You will not be charged during the free trial period.
  • Refunds: All purchases are processed through Apple. Refund requests must be submitted directly to Apple in accordance with their refund policies. We do not have the ability to issue refunds for App Store purchases.
  • Price Changes: We reserve the right to change subscription prices. Any price changes will take effect at the start of the next billing period following the date of the price change. Your continued use of the subscription after the price change constitutes your agreement to the new price.

5. Content Usage Policy

When using ResoPod, you agree not to use the App to generate, request, or disseminate content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Promotes violence, discrimination, or hatred against any individual or group
  • Contains or promotes sexually explicit material involving minors
  • Infringes upon the intellectual property rights of any third party
  • Attempts to generate malicious code, malware, or content intended to cause harm to computer systems
  • Involves deception, fraud, or impersonation of others
  • Violates any applicable local, state, national, or international law or regulation

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated this Content Usage Policy. We may also report illegal activities to appropriate law enforcement authorities.

6. AI-Generated Content Disclaimer

ResoPod uses artificial intelligence (Google Gemini) to generate responses. You acknowledge and agree that:

  • AI-generated content may contain inaccuracies, errors, or outdated information
  • We make no guarantee regarding the accuracy, completeness, reliability, or suitability of any AI-generated output
  • AI-generated content should not be relied upon for critical decisions, including but not limited to medical, legal, financial, or safety-related matters
  • You are solely responsible for evaluating and verifying any information provided by the App before acting on it
  • The App does not provide professional advice of any kind

The Developer disclaims all liability for any damages or losses arising from your reliance on AI-generated content provided through the App.

7. Intellectual Property

The App, including its design, code, features, graphics, and all related intellectual property, is owned by Zhewei Liang and is protected by applicable copyright and intellectual property laws.

You retain ownership of any content you submit or input into the App. By using the App, you grant us a limited, non-exclusive license to process your input solely for the purpose of providing the service. We do not claim ownership of your content.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy.

9. Termination and Account Deletion

You may stop using the App and delete your account at any time through the Settings menu within the App. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy. Deleting your account does not automatically cancel any active subscriptions; you must cancel your subscription separately through the App Store.

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, if you violate these Terms or engage in conduct that we determine to be harmful to the App, other users, or third parties.

10. Disclaimers and Limitation of Liability

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

11. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Colorado.

13. Apple App Store Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

  • Agreement parties: These Terms are between you and Zhewei Liang only, and not with Apple Inc. ("Apple"). Zhewei Liang, not Apple, is solely responsible for the App and its content.
  • Maintenance and support: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. Zhewei Liang is solely responsible for any maintenance and support.
  • Product claims: Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.
  • Intellectual property claims: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Zhewei Liang, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  • Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
